Terms of Use
The rules for using NZ Learner, what Pro includes, where the learning content comes from and the limits of a study app.
1. Acceptance of these terms
These Terms of Use apply to the NZ Learner app and related services provided by BlueOrbit (“we”, “us”, “our”). By creating an account or using the app, you agree to these terms. Our Privacy notice explains how we handle your information. If you do not agree, please do not use the app.
2. The service and independence
NZ Learner helps you prepare for the New Zealand Class 1 (car) learner licence theory test with practice questions, mock exams, scenarios, progress tracking and study reminders. The study content is built into the app and is available in several languages.
NZ Learner is an independent app. It is not affiliated with, endorsed by or an official product of NZ Transport Agency Waka Kotahi (NZTA) or the New Zealand Government. It does not issue licences, book tests or authorise you to drive. Follow official NZTA instructions when you apply for and sit your test.
3. Eligibility
You must be 16 or older to create an account and use NZ Learner. By using the app, you confirm that you meet this requirement. Licence eligibility, conditions and supervision rules are set by New Zealand law and NZTA, not by this app.
4. Accounts and responsibilities
You need an account to use NZ Learner. Give accurate information, keep your sign-in details secure and do not share your account. You are responsible for activity under your account. Tell us promptly at blue0orbit@gmail.com if you think someone else has used it.
You need an internet connection to create an account, sign in, delete your account, buy or restore Pro and watch rewarded ads. After you sign in, installed study content works offline.
Your learning records are stored only on your device, separately for each account. They are not backed up or synced, so uninstalling the app or clearing its data erases them, and they will not appear on another device.
5. Free use, Pro and billing
Free use. Free accounts include one free mock exam per local calendar day, counted on your device. When an ad is available, you can watch a rewarded ad for an extra mock exam or to open a scenario; ads are not always available.
NZ Learner Pro. Pro is a one-time in-app purchase through Google Play, not a subscription. It gives you unlimited mock exams, all scenarios without ads, full progress insights and an ad-free app. It costs NZ$4.99 in New Zealand; elsewhere, Google Play shows the local price before you buy. Google processes the payment under the Google Play terms.
Pro is linked to the NZ Learner account used to buy it. The app confirms the purchase on your device; we do not operate our own purchase server. To restore Pro, sign in with the same NZ Learner account on a device that uses the same Google Play account and connect to the internet. Pro cannot be moved to a different NZ Learner account, and deleting your account does not refund or transfer it.
Refund requests are handled under Google Play’s refund policies. This does not limit your rights under New Zealand consumer law.
6. Acceptable use
Use NZ Learner only for lawful, personal study. Do not:
- access or try to access another person’s account without permission;
- manipulate rewarded ads, the daily allowance, purchases or Pro access, or use bots or automated tools;
- copy, extract, scrape, resell or republish the app’s questions, images, translations or other content;
- reverse engineer, modify or interfere with the app or its services, except where the law allows;
- use the app to break the law or to harm others.
7. Learning content and acknowledgements
Content source: publicly available learning material from drivingtests.co.nz (DT Driver Training Ltd and its licensors). Some questions are original questions written by NZ Learner from official NZTA sources. Translations and app presentation are by NZ Learner.
Translations may contain errors. If a translation differs from the English text, the English text prevails.
Rights in third-party questions, explanations and images remain with their respective owners. Rights in the app and in NZ Learner’s own content belong to NZ Learner. We give you a personal, non-transferable right to use the app for your own study. References to NZTA or other official sources do not mean that they approve this app.
8. Study limitations
NZ Learner is a study aid. Practice scores, coverage and other progress measures describe your performance in this app only; they do not predict or guarantee an official test result.
The app does not contain the complete official NZTA question bank, and its questions have not been independently reviewed by an external expert. Road rules and test requirements can change, and questions, explanations, diagrams or translations may contain errors. Always check the current official New Zealand Road Code and NZTA guidance, and follow them where the app differs. Please report possible errors to blue0orbit@gmail.com.
9. Consumer rights and liability
Nothing in these terms limits or excludes rights you have under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, or other consumer protections that cannot lawfully be excluded. If you live in another country, you keep the mandatory consumer rights of that country.
We provide the app with reasonable care and skill. To the extent permitted by law, we are not responsible for loss that was not reasonably foreseeable, or that results from temporary unavailability of the app, from third-party services such as Google Play, Firebase or Unity, or from relying on the app instead of official guidance.
10. Suspension and termination
You can stop using NZ Learner at any time and delete your account in Profile → Delete Account or by following our account-deletion instructions. Deleting your account does not cancel or refund a Google Play purchase.
We may suspend or close an account, or remove Pro access that was obtained improperly, in cases of serious or repeated breach of these terms, fraud or abuse, or where the law requires it. Where reasonable, we will tell you first and explain why, and you can respond at blue0orbit@gmail.com. This does not affect your rights under consumer law.
11. Changes to these terms
We may update these terms when the app, our services or the law changes. We will publish the updated terms with a new “Last updated” date and highlight material changes in the app or on this website. If you keep using the app after the changes take effect, the updated terms apply. If you do not agree, you can stop using the app and delete your account.
